11. Delegatenſynode von Miſſouri, Ohio u. a. St. 1905. 165

impossible. The committee, however, holds it to be a sound principle that, where a sin is unknown in the circles concerned, one ought not needlessly make it public. It therefore proposes to the Synod that this principle be applied to the present case as well, and that this ruling be communicated to the protesters."
5.
"Pastor N. N. has submitted a petition to the Synod in which he points to several expressions used in *Lehre und Wehre* [Doctrine and Defense] and in the *Lutheraner*, and asks the Synod to examine whether these are not in themselves liable to misunderstanding and misleading.
"The committee proposes that the petition, which is couched throughout in a thoroughly brotherly tone, be read aloud." (The reading took place.)
"On careful examination, the committee has found that the expressions cited are not, in themselves, nor still less in their context, liable to misunderstanding or misleading."
6.
"Mr. H. Marquardt of Yorktown, Iowa, appeals against the judgment of the Iowa District regarding the ban imposed on the appellant. The minutes submitted, and the testimony of several representatives of the Iowa District, show that Mr. Marquardt has shown himself to be quarrelsome by returning again and again to matters already settled and by repeating unjust and even withdrawn accusations, and that he is therefore rightly banned. The District's judgment thus appears justified.
"As for an accusation raised against Prof. R. Pieper, the appellant is to be referred to him, respectively to the President of the Illinois District."
7.
"Mr. Pastor G. Gößwein was suspended from synodical fellowship by the Synod of the Western District in 1903, because, instead of accepting the brotherly discussion of the grievances he had submitted, offered by the 1902 Delegate Synod, he came out publicly against the Synod. The present protest is directed against this suspension, which in the committee's judgment was justified. But Mr. Pastor Gößwein continues, even now, to slander and defame the Synod and its officers. (See *Zeuge der Wahrheit* [Witness of the Truth, the Buffalo/Grabau Synod's periodical], May 1905, p. 33 ff. — "the Grabau relief fund" — *Z. d. W.*, June 1905, p. 41, thesis 5.) The committee therefore judges that the suspension stands rightly in force, so long as
