11. Delegatenſynode von Miſſouri, Ohio u. a. St. 1905. 155

ſchen Anſtalt in Springfield, Ill., ausgezahlt werde, was denn auch

worden.

11th Delegate Synod of Missouri, Ohio, and Other States, 1905. 155

...sought first to discharge the assignments that had been given to it by the last Synod.

"The first assignment concerned the request of the congregation at Freistatt, Mo., for the transfer of a plot of land from the Raithel Foundation for a congregational cemetery. The Commission was to decide, after examining the provision in the will, whether this request of the congregation could be granted. After examining the wording of the will and prior correspondence with Mr. Attorney Klein of Chicago, the administrator of the Raithel Foundation, the Commission decided that neither a purchase nor a lease of a piece of the Raithel Foundation's land could take place, because this could not be reconciled with the will of the founder, and that such a sale or lease would therefore risk the loss of the entire legacy.

"The second assignment concerned the H. Starke Legacy, of which, in accordance with the testator's will, $1000.00 had been handed over to the Commission for administration. As soon as the Starke Legacy came up for distribution, the Commission invested the portion assigned to it, $991.60, profitably according to its best judgment, and determined that the proceeds should be paid out to a poor student of the theological institution at Springfield, Ill., which has, in fact, already happened twice.

"The Commission was sent, through the General Treasurer, $500.00 from the Dirkson Foundation of Bingen, Ind., for administration, with the remark that we should invest this money according to our best judgment. This has been done. The proceeds are to be used for the benefit of General Home Missions.

"The legacy of Marie Boye of St. Paul, Ill., in the amount of $800.00, bequeathed for the orphaned and deaf-mute, was transmitted to the General Treasurer by the Honorable General President. The Synod must decide to which funds or institutions this money is to be paid.

"The Synod must also make a decision regarding the H. Starke Legacy No. 2, consisting of a valuable piece of real estate. A favorable offer for the sale of this property had been made to the Synod, and the administrator of the legacy, Mr. Koch of Milwaukee, had also advised accepting it; but Mr. Dr. Pieper, as General President, believed he did not have the authority to enter into the deal without the Synod's consent.

"From Fort Wayne, Ind., a legacy from Lena Pretsch has been transferred to the Commission, consisting of a cash sum of $815.22 and a number of notes representing a value of $1300.00...
