Ev. Luth. Synod of Missouri, Ohio, and other States” (Synodalhand⸗
buch 1888, S. 69; 1899, S. 86); „Concordia⸗College der Deutſchen
Ev.⸗Luth. Synode von Miſſouri, Ohio und anderen Staaten“ (18. Syno⸗
dalber., 3. Delegatenſynode, S. 63);
“in the County of Allen” kennt, die erſt “German Theological Semi-
nary of the German Ev. Luth. Synod of Missouri, Ohio, and other
States” hieß und jetzt “Concordia College of the German Ev. Luth.
Synod of Missouri, Ohio, and other States” heißt, und deren Auf⸗
ſichtsbehörde ſeit dem 15. Mai 1851 die ſogenannte Collegefarm gehört;
gehabt hat;
18. Synodalbericht, 3. Delegatenſynode, S. 63);
“Charter of our Fort Wayne Institution” (Synodalhandb. 1888,
S. 66; 1899, S. 84);
Aufſichtsbehörde darüber zu verfügen hat “for the sole use and

42 Proceedings of the 29th General or
e) that this name, however, was changed by a special act of the
Indiana legislature of April 5, 1881, in the "charter," so that it
now reads: "Concordia College of the German Ev. Luth. Synod of
Missouri, Ohio, and other States" (Synodical Handbook 1888, p. 69;
1899, p. 86); "Concordia College of the German Ev. Luth. Synod of
Missouri, Ohio, and Other States" [German: "Concordia-College der
Deutſchen Ev.-Luth. Synode von Miſſouri, Ohio und anderen Staaten"]
(18th Synodical Report, 3rd Delegate Synod, p. 63);
f) that the State of Indiana knows only one institution of the
Missouri Synod "in the County of Allen," which was first called
"German Theological Seminary of the German Ev. Luth. Synod of
Missouri, Ohio, and other States" and is now called "Concordia
College of the German Ev. Luth. Synod of Missouri, Ohio, and other
States," and to whose board of control the so-called College Farm
has belonged since May 15, 1851;
g) that our Synod itself has, until now, through its conduct and
its actions, taken this same position, in that it
aa) has had only one board of control for its Fort Wayne
institution;
bb) raised no objection when informed of the change of name, which
"was achieved for the board of control with the help of Mr.
Sarnighausen and especially of Senator Bell," "whereby, without
doubt, a great service was rendered to the Synod" (so it states in
the 18th Synodical Report, 3rd Delegate Synod, p. 63);
cc) has headed the entire section of our Synodical Handbook that
deals and speaks of this institution, as it once was and now is:
"Charter of our Fort Wayne Institution" (Synodical Handbook 1888, p.
66; 1899, p. 84);
dd) has, for over fifty years now, left the management of the
College Farm in the hands of the local board of control and raised
no objection to the proceeds of the farm benefiting the Fort Wayne
institution.
II. Local attorneys, who have carefully examined the "charter" of
the college, the deed of purchase for the farm, and the synodical
reports, agree with us that the farm, and naturally also its
proceeds, belong to the Fort Wayne institution, and that the local
board of control is to administer it "for the sole use and benefit
and maintenance" of this institution — indeed, that under the laws
of the State of Indiana it may administer it only in this way.
III. In the 12th and 13th Synodical Report (1864 and 1866, p. 82,
bottom) we read the following resolution: "A further proposal was
that the College Farm be rented out, or otherwise put to use, in a
more advantageous manner than heretofore. The Synod resolved to
leave this matter likewise to the board of control, which, with the
assistance of two or three knowledgeable men from the Fort Wayne
congregation, should do whatever would bring the Gymnasium the
greatest benefit from this land."
