ſtets unter der Direction und Controle (exclusive government, manage-
ment, direction and control) der evangeliſch⸗lutheriſchen Concordia⸗Synode
von Pennſylvanien und anderen Staaten. Sollte jedoch beſagte Concordia⸗
Synode ſich auflöſen, ſo gehen alle Rechte derſelben über in die Hände der⸗
jenigen Synode im Staate Pennſylvanien, welche von der evangeliſch⸗
lutheriſchen Synodalconferenz von Nord⸗Amerika dazu beſtimmt wird.
Und löſt ſich auch dieſe Synode oder die Synodalconferenz auf, dann ſollen
die Rechte der Regierung, Leitung und Controle demjenigen ‚board of
charities‘ im Staate Pennſylvanien anheimfallen, welches an der Lehre
der evangeliſch⸗lutheriſchen Kirche nach dem Concordienbuche vom Jahre
1580 feſthält.

„Eine Synode hat alſo nach dieſem ‚Deed‘ nicht das Eigenthumsrecht,
ſondern nur das Recht zu leiten, anzuordnen, zu dirigiren und zu contro⸗
liren. Laut des ‚Deed‘ ſteht es der Synodalconferenz nun zu, nach Auf⸗
löſung der Concordia⸗Synode eine andere Synode im Staate Pennſylvanien
mit der Oberleitung dieſer Anſtalt zu betrauen.

„Ihre Committee ſchlägt nun vor, die Synodalconferenz möge er⸗
klären, daß der Oeſtliche Diſtrict der Synode von Miſſouri, Ohio und
anderen Staaten die Oberleitung und Führung der Concordia⸗Waiſen⸗
heimath in Butler County, Pa., übernehmen möge. Nach wie vor werden
diejenigen Paſtoren und Gemeinden dies Werk der Barmherzigkeit weiter
erhalten und führen, die es bisher gethan haben; doch ſind ſie für alle ihre
Handlungen der Synode gegenüber verantwortlich.

Dieſer Bericht wurde angenommen und demgemäß beſchloſſen,
daß die Synodalconferenz hiermit den Oeſtlichen Diſtrict der Synode von
Miſſouri, Ohio u. a. St. beſtimmt als diejenige Synode, welche fernerhin
das „exclusive government, management, direction and control“ der
Concordia⸗Waiſenheimath iu Butler County, Pa., laut des Deed zuſteht.

always under the direction and control (exclusive government, manage-
ment, direction and control) of the Evangelical Lutheran Concordia Synod
of Pennsylvania and other States. Should, however, the said Concordia
Synod dissolve, all rights of it pass into the hands of
that synod in the State of Pennsylvania which is designated for this by the Evangelical
Lutheran Synodical Conference of North America [Synodalconferenz].
And if this synod or the Synodical Conference also dissolves, then the
rights of government, direction and control shall fall to that 'board of
charities' in the State of Pennsylvania which holds fast to the doctrine
of the Evangelical Lutheran Church according to the Book of Concord of the year
1580.

"A synod, then, according to this 'deed' has not the right of ownership,
but only the right to direct, to order, to manage and to con-
trol. According to the 'deed' it is now for the Synodical Conference, after the dissolution
of the Concordia Synod, to entrust another synod in the State of Pennsylvania
with the supervision of this institution.

"Your committee now proposes that the Synodical Conference declare
that the Eastern District of the Synod of Missouri, Ohio and
other States take over the supervision and management of the Concordia
Orphans' Home in Butler County, Pa. As before, those pastors and congregations
will continue to maintain and conduct this work of mercy
who have done so hitherto; yet they are responsible for all their
acts to the synod.

This report was adopted, and it was accordingly resolved
that the Synodical Conference hereby designates the Eastern District of the Synod of
Missouri, Ohio and other States as that synod which henceforth
is entitled under the deed to the "exclusive government, management, direction and control" of the
Concordia Orphans' Home in Butler County, Pa.
