ordentlichen Fällen dieſe neue Inſtanz in's Leben rufe. —

nächſt an ſeine Diſtrictsſynode gewieſen.

80 Proceedings of the 20th General or

The first six of the last-named presidents [Präsides] and pastors are
hereby elected members of the Election Committee by majority vote.

Resolved, that if, before the next Delegate Synod, one of the members
of the Election Committee should depart from its ranks, the Committee shall
at once fill the vacancy again.

Resolved, that such filling of the Election Committee shall take place
according to the order of the last-named but not elected six candidates,
as their votes rank, by majority.

Court of Appeals [Appellations-Instanz]

This court was created by the Delegate Synod in the year 1881 for
extraordinary cases. It consisted in this, that bypassing the District
Synod, appeal could be made directly from the District President to the
General President, and from him only to the General Synod. (See the 18th
report of the Delegate Synod of the year 1881.)

Even then the General Synod recognized "that the constitution
establishes the rule: the next instance to which appeal can be made from
the District President is not the General President, but the District
Synod as such, and only its decision is to be submitted to review by the
General President." Yet it was believed no violation of the constitution
was committed if, while upholding the rule for ordinary cases, this new
court were called into being for wholly special, extraordinary cases. —

Nevertheless, the Delegate Synod now in session, upon closer
examination, had to become convinced that this court, created in a time of
distress, could not be reconciled with the constitution of the synod, and
that its continued existence therefore could not be maintained. Hence

Resolved, that the new Court of Appeals created in the year 1881 be
abolished again, because it not only offends against the letter of the
constitution but is also contrary to the principles of the synod.*)

——————

*) As a result of this resolution, the appeal directed by Pastor J.
Karrer to the General Synod lapses; that is, Pastor K.'s appeal is now
referred first to his own District Synod.
