Modus Procedendi in Intersynodical Controversies.
(Translation of preceding German Committee Report.)

The committee appointed by the Hon. Ev. Luth. Synodical Con-
ference of North America at the time of its last session at Lockport,
N. Y., during the month of August, 1926, for the purpose of establish-
ing a modus procedendi in intersynodical controversies, respectfully
submits the following recommendations for the consideration of that
honorable body: —

1. We recommend that paragraphs 10 and 11, under the caption

souri, Ohio, and Other States, fifth edition, German, St. Louis, Mo.,
Concordia Publishing House, 1924, pp. 152—155), be stricken.

2. We further recommend that the following articles regarding
so-called opposition congregations and the regulation of intersynod-
ical controversies be substituted for the paragraphs to be stricken,
viz.: —

I.

In case an excommunicated person consults a pastor of another
synod, the pastor approached shall not permit himself to pass judg-
ment upon the allegations of the excommunicate; he may, however,
confer with the former pastor of the excommunicate for the purpose
of obtaining information. The said pastor is then under obligation
to give the necessary information as to the dealings which ended in
the excommunication. In such cases the District officials (visitors
and presidents) may be called into consultation. If it is found im-

of the Ev. Luth. Synodical Conference of North America. 1928. 69

IV.

In intersynodical disputes the district presidents are the first instance, the presidents of the synods the second instance, and the synods the third instance.

If, in the handling of a public dispute in a congregation, a member of another synod is desired as a person of trust, this can be done only if all those concerned agree to it.

If members of another sister congregation are requested as witnesses in a public dispute, they shall be admitted at the hearing of witnesses.

In the name and by commission of the committee:
E. Benj. Schlüter, Secretary.

For deliberation and report on this report the President appointed the following committee: Pastor H. H. Ebert, chairman; Prof. W. Schaller, secretary; Prof. M. J. F. Albrecht, President Alex Ulrich, Pastor H. J. Bouman, Mr. G. F. Burger, Teacher L. H. Rullman. This committee recommended adopting the report of the first committee unchanged in its original form. This was done, and thus this modus procedendi is now in force.
