SEMINARY AND UNIVERSITY EDUCATION 221

3.8.3.7.2 As soon as an impending presidential vacancy ##+the
offiee-of president-is known, the board of regents, with prior con-
sent of the Board for University Education, shall issue #-en-effietat
pertedieatofthe-Syned-a request t_eal-for the nomination of candi-
dates for the presidency of the institution to nominating entities.

Persons nominated shall promptly be notified of their nomination |

and shall desertbe-receive a description
of the office and qualifications desired to fill it.

COMMENTARY: The significant change in this paragraph is al-
lowing the board of regents the option of selecting the method of noti-
fication of nominating entities. The regents may elect to use the offi-
cial periodicals, send a letter to nominating entities, or communicate via
electronic means.

(a) Candidates may be nominated by congregations of the
Synod, the Board for University Education, the board of regents,
and the plenary faculty of the institution.¢6} All nominations must
be filed with the designee of the board of regents within 60-30 days
of the-date-oFits-published+requestnotification unless the request

sets a later date.

COMMENTARY: The significant change in this paragraph is a re-
duction of the time from 60 days to 30 days.
€8}¢5(b) Persons nominated may decline to be candidates, and
their names will be removed from the list of nominees. #}2)Nom-
inees who allow themselves to be listed as candidates will be asked
to pledge, if appointedeaHed, to render a decision within 15 days of
receipt of the appointmenteaH, unless granted an extension by the
board of regents.

<8}3(c) The designee of the board of regents shall publish in
an official periodical of the Synod the names of the nominees who
have permitted themselves to be candidates and the date on which

the election i is 3 to o be Deldr which shell net be lose than 30-deys-after

“eXd) d) All recommendations, statements of qualifications of any
nominees, of objections to any nominee with reasons therefor, must
be filed with the board of regents before the time fixed for the elec-
tion. If a charge of false doctrine or offensive life is registered, the
board of regents shall investigate and reach a decision on such
charge before proceeding with the election.

_ exe) A qualifications committee of nine persons seareh-eorm-

hall be formed when the re-

quest for nominations is issued, composed of four persons and one
alternate elected by the board of regents (one of whom shall serve

as committee chair), three full-time faculty members and one al-

ternate ¢elected by the faculty-with-ene-akernate), and two full-time

members of the staff and one alternate clected by the Staff three

shall not vote while serving as alternates. ¢4-4-The seareh-eom-
#ittee qualifications committee shall make a written report of the
needs of the institution, the requirements of the Synod, and the re-
quired and desired qualifications of the nominees. ¢¢4-2)-This writ-

ten report shall be reviewed and adopted by the electors as the cri-
teria for evaluating the qualifications of candidatesshared-with+the
eleeters.

COMMENTARY: There are five significant changes in this para-
graph, they are: (1) committee is renamed “qualification committee”
rather than “search committee, in its first phase of activity” (2) board
of regents selected members increased from three to four and not lim-
ited to regents (the board of regents might decide to send a member of
its foundation, or other significant supporter); (3) the chairman of the
committee is designated as a board of regents selectee; (4) two staff
members are included in the qualification committee; and (5) electors
are required to adopt the selection criteria.

¢e}(f) In the second phase of the search process, a screening
committee of not more than twelve persons shall consist of the
members of the qualifications committee plus such others as the

board of regents shall select to serve. The screening committee will

The board of regents shall make available to the screening com-
mittee seareh-eormmittee-all information it receives regarding the
candidates. ¢§-Open forums shall be conducted with administra-
tive staff, students, and other constituents as deemed essential by
the screening committee seareh-eormmittee-to gather extensive input
to the process.¢e}4 The screening committee seareh-eommittee
shall submit to the electors a report of evaluations based upon the
adopted qualifications of the electors and recommendations re-

garding the candidates.

COMMENTARY: There are three significant changes in this para-
graph: (1) committee is renamed “screening committee” rather than
“search committee, in its second phase of activity”; (2) membership in
the committee changes from three regents and six faculty to a continu-
ation of the members of the qualification committee plus up to three ad-
ditional members selected by the regents (This change further develops
the concept of accountability of the president to the board of regents.);
and (3) the chairman of the committee is one of the board of regents
appointees. The function and task of the committee is unchanged.

#}-(g) At least two weeks before the election_at a meeting of the

board of regents, the electors shall_meet to hear the report of the
screening committee and to establish fmelze-the slate of nominees

to be interviewed in the election meeting. ¢s-The screening com-
Inittee seareh-eormmittee-shall prepare-present a list of not more

regarding candidates . 44>-If there are per-

sons placed on the slate who were not on the reeni
tee’s seareh-eommittee-s-recommendation list, they shall complete
all interviews and questionnaires prior to the election.
COMMENTARY: The only significant change in this paragraph is
allowing the screening committee to suggest “not more than five” can-
didates rather than requiring the committee to present “at least five.”
(h) At a speeta+meeting of the board of regents held to elect a
president, there shall be present and voting as electors the mem-
bers of the board of regents as a group with one vote (the district
president on the board not voting with the board); the district pres-
ident elected to the board or his official representative with a dis-
tinct vote; the President of the Synod or his official representative
with one vote; and the chairman of the Board for University Edu-
cation or his/her official representative with one vote. The execu-
tive director of the Board for University Education shall attend as
an observer.

€p-(i) The election shall be held on the day designated in the
notice published in ¢ke-an_ official periodical of the Synod or as
soon thereafter as feasible. The electors shall give due considera-
tion to the recommendations and statements of qualifications and

objections submitted about candidatesen-behal-efel-neminees.

e-(j) The titiatelection of a president shall require three of
four elector votes. 4}-The board of regents shall extend the formal
appointmenteeH promptly after the election and submit its action
to an official periodical of the Synod for publication. If the elec-
tors are unable to finalize the slate or complete the election, they
shall postpone the election and, if desirable, request the board of
regents to issue a new requesteal for nominations.

4)-(k). Whenever an appointment freal-is declined, the chair-
man of the board of regents shall give notice to all nominating en-
tities + and shall promptly call
another meeting of the electors, at which meeting the appointment
eat-may be reissued or another person may be elected from among
the remaining candidates, or the board of regents may be requested
by the electors to issue a new eaHrequest for nomineeseandidates.
