Sistitutional Matters

Education.

The reaction of the £Apnittee on Cpiteti tutional Matters was that the
apparent contradiction could be explained in this way that as far as the object-
ives. of Synod are concerned, the Superintendent is responsible to the Visitor,
but as far as teaching techniques are concerned, he is responsible to the Board
of Education. However, the Committee agreed that the area in which the Superin-
tendents work should be more clearly defined and that certain changes in the Hand-
book are indicated, which could be brought before the next Synod. The Superinten-
dents’ Conference could set up its suggested changes in the Handbook and consult
with the Board for Parish Education in the matter. Such changes should then be
reviewed by the fiji ttee on Constitutional Matters before being brought before v

Synod.

3. The (ymittee concerned itself with the clarification of Article XI, Bl.
(Cf. Minutes, pages 9f; page 16, paragraph 10; page 20, 1, c.) It is clear that
the President of Synod has the supervision of all officers of Synod, including
District Presidents. It was agreed that when the President of Synod has admon-
ished a District President according to Article XI, and the admonition proves
fruitless, he shall refer the matter to the Vice-Presidents of the District for
proper procedure (Cf. Section 5.23). The next instance would be the Board of
Appeals of the District, after which the case may be submitted to the Board of
Appeals of Synod by the President. It was decided to ask Synod to add to Section
5e23 the words: “Except in cases in which the President of Synod has taken

“Official action under Article XI, B, 1&2." Note: It was understood that in /

Section 5.23, line 4, it should read: the District President, instead of "Presi-
dent". |

4. Pastor Harold H. Hecht had submitted several questions in connection
with the revision of the constitution of his congregation in the interest of
avoiding public scandal when a controversy arises in a congregation and a decision
must be made about property matters, He was to be answered to the effect that the

entire question of property rights in case of a division in a congregation is so
