LCMS in mixed marriages, and if not, what is the intent. The Commission decided that Res. 3-25 needs
no clarification but speaks for itself and concluded that the resolution is to be construed as the Synod's
official approval of the position statements (quoted in the resolution) of the Commission on Worship, the
Commission on Theology and Church Relations, and the Council of Presidents as a valid interpretation of
Article VI of the Synod's Constitution.
342. English District Bylaws (Ag. 653): It was agreed to hold this item for the time being.
343.
California-Nevada District Evasion of CCM (Ag 933A,C, 966): The Commission concluded that
this is no longer a live item and removed it from the agenda.
344. New Jersey Bylaw Revision Re Indemnity (Ag. 995): The Commission agreed to hold this on the
agenda since no word had as yet been received from legal counsel Draheim.
345. Gerald Miller Case (Ag. 1022 A): Since up to this time the Commission had merely received a
carbon copy dated August 27, 1976 and no further communication, it resolved to remove this item from
the agenda.
346. Ohio District Full-Time Presidency Question (Ag. 1028): Again, since the Commission had received
only a carbon copy on this matter and had not received any direct request since September, 1976, it was
decided to remove the matter from the agenda.
347. Brazil District Bylaws (Ag. 1202, A): This item will be held on the agenda.
348. Federation of Lutheran Churches of Cincinnati (Ag. 1205): The question of affiliation has been
raised with the CTCR with a carbon copy to the CCM. For the time being this will be retained on the
agenda to see whether any direct request is made of the CCM.
349. New Orleans Federated School (Ag. 1224): An officer of this organization had asked whether it was
permissible for a congregation which had withdrawn from the Synod and joined the AELC to continue in
this federation since the Constitution of the organization permits membership to member congregations
of the Synod and those who are "in doctrinal agreement" with the Synod. The Secretary had written that
it would need to be determined whether that congregation was really in doctrinal disagreement with the
Synod and for that reason had left it; otherwise, there might be reason to regard the congregation as
schismatic. He had requested further documentation but none had been received. The Commission took
up the request and agreed with the evaluation expressed by the Secretary in his correspondence.
However, since no confirming documentation had been received though requested, the Commission decided to defer action for the time being, expressing the view that to make a ruling it would need more
information as to whether the AELC congregation had withdrawn from the Synod because they are not in
doctrinal agreement with it.
350. Unanimous Vote for Excommunication (Ag. 1210): The chairman of the Committee on
Constitutions of the Iowa District West, Rev. W. C. Ostermeyer, had asked whether unanimity was
necessary or whether a three-fourths_vote_of those present was sufficient. The Secretary had replied that
the traditional position had been that such an act should be unanimous and that those objecting to it
should first be dealt with and further instructed or the congregation should reverse its judgment. The
Commission resolved to ratify this response and so to notify Pastor Ostermeyer.
351. South American Colleges (Ag. 1212): The Commission was in receipt of a carbon copy of a letter
addressed by the chairman of Floor Committee #6 to the Board for Higher Education regarding more
