of Order, pp. 339 350 215). Although the point of order had not been raised immediately during the
course of the meeting, the action did seem to conflict with the Bylaws; this fact removes the necessity for
a point of order to be raised then and there. In any event, without adopting an official opinion in a
telephone conference call, the Commission members felt that it might not be necessary for another circuit
meeting to be held and that Pastor X would need to be recognized as the properly elected delegate.
Adjournment followed.

Minutes of the Meeting of the Commission on Constitutional Matters
December 10, 1976
192. John Klotz opened the meeting with prayer. All members were present. The minutes of the previous
meeting and conference calls were approved as submitted.
193. Position Statements, Nominees (Ag. 1151): The Committee for Convention Nominations had asked
whether their intention of requesting nominees to state their positions in the area of theology and the
Synod's mission would be in violation of the Synod's Constitution and Bylaws. After some discussion the
Commission invited Chairman August Mennicke and Corresponding Secretary Wilbert Rusch to discuss
the matter. Afterwards the Commission resolved to postpone action on this request to determine what
action the Nominating Committee might propose in the future. The Commission expressed considerable
concern about adding such a statement to the biographical information required in the bylaw and felt that
it might be wiser for the convention itself to make a decision in this respect.
194. Report to Convention (Ag. 1148): The Secretary submitted a draft of what might be the
Commission's report to the Dallas convention. This was read for tentative reaction and approval, subject
to later action in the February meeting. Particular attention was given to the introductory paragraphs of
Section II regarding concern' for "the common good." The Commission also took several actions reflected
in the following paragraphs among Section IV recommendations:
195. Suggested Bylaw Revisions Re Acceptance of Overtures (Ag 1063): The Commission decided to
resubmit its argumentation regarding Bylaw 1.27c and its proposed revision of that bylaw to the Dallas
convention. (Attached to the Minutes; see also Minutes 133).
196. Reporting of Tally (Ag. 1060): The Commission took the same action in regard to this former
proposal to the Anaheim convention. (Attached to Minutes; see also Minutes 130).
197. Official Conferences (Ag. 1061): The same action was taken with respect to the Commission's
recommendation to New Orleans regarding a new bylaw concerning official conferences. (Attached to
Minutes; see also Minutes 131).
198. Greenhaven Church, Sacramento, California (Ag 1137): The Secretary shared with the Commission
correspondence regarding this problem. It seems that this congregation regards itself as a member but it
has been listed consistently as a non-member congregation and there is no record of it ever having been
received into membership of the Synod although some revisions of its constitution had been approved by
a CaliforniaNevada District convention.
199. Election of Delegates (Ag. 1062, 1062A): The Commission resolved to recommend to the Dallas
convention a refinement of its original recommendation to the Anaheim convention for revision of this
