2.
In the resolved it is not clear what "financial and other necessary support" is involved. Does
it involve housing? Living expenses? Attorney's fees? Court costs?
3.
Expenditure of District funds to provide financial and other support for District officials in
the event an attempt is made to remove them from office would be made at the peril of the
officers and directors who so expend such funds.
4.
In the event that a court of law would determine that the said District official(s) should be
suspended, then the persons who did expend funds in the defense of such person(s) very
likely would be personally liable for the amount of District funds expended.
372. Committee of 20 (Ag. 719): Klotz and Mueller reported that two meetings of this committee had
been held without much being accomplished. Additional meetings have been urged, but the Seminex
representatives have not yet been agreeable to a resumption of these discussions.
373. South Wisconsin Campus Congregation (Ag. _770): The Commission ratified the reply sent by the
secretary.
374. Teacher Serving ALC Congregation (Ag. 771): President Barth had inquired about the status of such
an individual. The secretary had referred him to Dr. Al Senske for further information. Since no further
word had been received from President Barth it was decided to hold this item until the next meeting.
375. Service Credit Toward Sabbatical (Ag. 776): In answer to a request for a ruling from Personnel
Director William Barge, the Commission ruled that the words of Bylaw 2.11 a "who has served the Synod
10 years" must be interpreted to mean that previous full-time salaried service in any capacity rendered to
the Synod at a synodical school or elsewhere can be counted toward the requirements for a sabbatical.
376. Can a CCM Ruling Be Disregarded? e.g., Manteca Congregation, California (Ag. 777 & 783): Rev.
Wm. Grunow of San Leandro, California had asked whether a ruling of the CCM could be disregarded.
The reference was especially to the case in Manteca which he alleges has not yet been settled in spite of a
CCM ruling. Rev. Martin Taddey had also addressed an inquiry to the Commission regarding the
situation. The Commission ratified the letters which the secretary had sent to Pastors Grunow and Taddey
with reference to this fact, indicating in the latter instance that it was assumed that the Manteca
congregation has long since decided whether to join the LCA or the LCMS. The Commission decided to
respond further to Rev. Wm. Grunow as follows:
A reasonable time must be allowed to give force and effect to rulings of the CCM and to have the
same implemented. This may vary from one fact situation to another.
We take for granted that honorable men pursue honorable means to honorable ends and that in the
case cited by you the District President will act accordingly.
In the event that in your opinion any officer of your District is not implementing the rulings of the
CCM within what you consider a reasonable time we suggest that you discuss this matter in a
Christian way with the District officials.
A carbon copy of this communication is to be sent to President Jacobs and a blind carbon copy to Pastor
Taddey.
