38. Ewald Otto Questions Re Procedures (Ag. 474): Several months earlier Ewald Otto, chairman of the
Board of Control of Concordia Seminary, St. Louis, had addressed quite a number of questions to the
Commission. The Commission had postponed consideration of two questions, namely, whether the rules
of procedure in Bylaw 5.31 did or did not apply when the Board of Control takes the place of the
Commission of Adjudication. The Commission ruled that the provisions of Bylaw 5.31 do indeed apply
when the Board of Control has decided to proceed under Section 6.79d.
39. Constitutionality of New Orleans Convention Resolutions (Ag. 495, 485, 450, 451, 462, 487B, etc.):
Considerable time was spent on the last afternoon considering this vexing question in its various aspects.
Elmer Luessenhop and Herbert Mueller had prepared "devil's advocates" papers setting forth what they
regarded as differing positions which could be considered as perhaps the two opposing approaches to
these questions. These papers were read and discussed. Members were asked to take both under
advisement, to give further attention to them, with perhaps even a view toward finding new approaches.
The meeting adjourned shortly after 5:00 with a blessing by the Secretary.
Herbert Mueller, Secretary
