MINUTES OF MEETING OF COMMISSION ON CONSTITUTIONAL MATTERS

OCTOBER 8 &9, 1964
Fort Wayne, Indiana

199, The Meeting was opened with prayer by Dr. Herbert Berner.

read after the words "South Wisconsin" in paragraph 179 had been changed

to ''Southern'"',

201, A communication was presented from Pastor Leonhard J, Rausch,

Counselor of Northwest II (Napoleon) Circuit of the Ohio District, The

Circuit Counselor referred to the Resolution adopted during the late hours
of the 1964 Convention of the Ohio District declaring that the election of

the pastoral delegate and the alternate chosen by the Northwest II (Napoleon)
Circuit to attend the 1965 Detroit Convention be not certified "since the
pastoral delegate and the pastoral alternate are incapable of carrying out

the provisions of the Synodical HANDBOOK in paragraph 1,55",

202, A very long discussion now developed centering about the
question whether the Synodical HANDBOOK contains any provisions authoriz-
ing such an action with reference to duly selected representatives from
Electoral Circuits, After viewing the various aspects of the case and after
reviewing the entire situation, the Commission came to the unanimous
decision that this action on the part of the Ohio District of The Lutheran

Church - Missouri is invalid.

203. It was agreed that Commission Member Gerhardt Jersild should

formulate the opinion which is to be sent to Circuit Counselor Rausch,
