Minutes of the Commission on Constitutional Matters
July 19, 1995
138. : A layman had been elected on the first ballot to membership on the Board of Directors of the Synod.
A pastoral nominee for the Board was from the same District. The question asked was whether in the light
of Bylaw 3.190 his name should be retained or removed from the slate of nominees.
The Commission concluded that the pastoral nominee would be ineligible for election. Bylaw 3.190
contains the statement
"No more than one of the ordained ministers or laypersons may be elected from any one
District."
In reviewing this statement, the Commission noted that ordained ministers and laypersons are both objects
of the preposition "of” and consequently the bylaw was forbidding of two ordained ministers, two
laypersons, or one of each to come from the same District.

1. Opening : Chairman Groh called the first meeting of the Commission on Constitutional Matters in the
1995-98 triennium to order and asked the Secretary to open the meeting with prayer.
2. Arrangement through Proper Channels (Ag. 2012) : A District President had written to the
Commission on Constitutional Matters with a number of questions relating to a District President's
intervention in a congregation which appeared to be involved in ongoing conflict. The congregation had
questioned actions which were taken by the District President and had done so on the basis of the fact that
he had, according to them, not arranged for a visitation of the congregation "through the proper channels."
The District President had, therefore, posed a number of questions based on Bylaw 4.75 of the Handbook
and Article VII and XII, 7, of the Constitution of the Synod.
After reviewing a proposed response to the questions which had been asked, the Commission decided to
respond as follows:
