Secretary, which indicated that if they are to be included, the Commission is probably ultimately
responsible but that other groups, such as Board for Professional Education Services and Council of
Presidents should be included in the process.
75. Foundation Articles and Bylaws (Ag. 1616): This item is to be retained on the agenda. Judge Groh
will provide a written comment on them at the next Commission meeting.
76. Constitutional Validity of an Elector (Ag. 1710): Preparations are being made for the election of a
president for the Saint Catharines Seminary in September, 1984. At a recent meeting, the Board for
Professional Education Services delegated its vote in the electoral process to the chairman of the Lutheran
Higher Education Committee of Canada, who attends meetings of the Board regularly as a representative
of those churches in Canada but does not have voting privileges at the meetings of the Board. A question
was raised with regard to the constitutionality of such action. In reply, the Commission ruled that the
chairman of the Board has the power of appointment. He can designate an official representative in the
election. There is no bylaw requirement that the representative be a member of the Board.
77. Minnesota South Bylaws (Ag. 1643, A): Retain on the agenda
78. South Wisconsin District Bylaws (Ag. 1699): Retain on the agenda, assign to Dr. Hopmann.
79. Iowa District West Bylaws (Ag. 1660): Dr. Eberhard reported that he had reviewed Iowa District
West Handbook and had found the constitutional and bylaw provisions not to be in conflict with the
Handbook of the Synod. The Commission accepted the report as presented.
80. Adjournment: The meeting was adjourned with the benediction pronounced by Chairman Eberhard.
Walter L. Rosin, Secretary
