30. Action on Reconsideration (Ag. 1690, A-C): After some discussion, the Commission decided to delay
action on the-request for reconsideration. Roland Hopmann, Sam Nafzger, and Walter Rosin were asked
to consult with Dr. Bohlmann on the issue prior to further consideration by the Commission by means of
a telephone conference on April 6, 1984, at 10:30 a.m., CST. The Secretary will inform Concordia
College, St. Paul Board of Regents that the Commission is considering an application for reconsideration.

Commission on Constitutional Matters - April 6, 1984
31. Action on Reconsideration (Ag. 1690, A-C): Dr. Sam Nafzger and the Secretary reported on
conversations with Dr. Bohlmann relating to the request for reconsideration of eligibility for a woman to
serve as the president of a synodical college. The Commission agreed to uphold its previous ruling. The
Secretary was asked to prepare a letter, informing the Board of Regents of Concordia College, St. Paul,
and to share the letter with Commission members before forwarding it.
32. Adjudication and Appeals Procedure (Ag. 1694): A series of questions which would likely be
presented to the Commission regarding adjudication procedures carried out by the Missouri District
Commission on Adjudication had been forwarded to Commission members. Because of the complexity of
the issues the Commission declined consideration prior to its regularly scheduled meeting

33. Opening Devotion: Dr. Roland Hopmann led the Commission in an opening prayer, asking for God's
guidance and blessing upon the work of the Commission. Present for the Commission meeting were Dr.
Carl Eberhard, Dr. Roland Hopmann, Dr. Walter Rosin, and Judge Gene Schnelz.
34. Minutes: The minutes for March 9, 1984, as well as the minutes of telephone conferences on March
28 and April 6 were approved as presented.
35. Conflict of Interest, Bylaw 6.01, c (Ag. 1697): Concordia College, St. Paul, Minnesota, had requested
a ruling regarding eligibility for membership on its Board of Regents for a person who was contracted for
student teaching supervision and who was receiving a stipend from the college for that service. The
Commission stated that based upon Bylaw 6.01, c, as well as Bylaw 2.69, it is clear that anyone entering
into gainful employment with a college or seminary is precluded from serving on that institution's Board
of Regents. However, the term "gainful" is subject to interpretation. It is difficult to determine whether
the small amount of compensation referred to in contracts between a college and a member of Board of
Regents of that college, namely, Concordia College, St. Paul, Minnesota, is to be interpreted as "gainful
employment." If, in fact, a distinct profit is being made, Bylaw 6.01, c, as well as Bylaw 2.69 apply, and
the member being compensated must be excluded from membership on the Board of Regents. The Board
of Regents must determine whether such is the case. The Commission suggested that in preparing
contracts for minor service, the term "salary" be replaced by a word such as "reimbursement" or
"compensation." It further suggested that in designating the lines of responsibility, contracts should
indicate only the immediate supervisor; in this case, the coordinator of field experiences, rather than a list
of the entire chain of command.
