33. Interpretation of Bylaw 5.55, Last Sentence (Ag. 1398): Pastor Richard W. Manns, chairman of the
New England District Board of Adjudication, had taken issue with a previous letter from the Secretary
informing him that the Commission had always interpreted the sentence in question to mean that if a
District Commission of Adjudication, because of resignation or disqualification, needs to resort to the
filling of vacancies, it is to fill that vacancy from the Commission of Adjudication of another District
rather than from any other commission within the District itself. Once again the Commission ratified this
interpretation.
34. Bus Schedules (Ag. 1406): The Commission took note of a new schedule of buses running between
the airport and downtown for thirty cents.
35. Dr. John Klotz closed the meeting with prayer
Herbert Mueller, Secretary

Minutes of the Commission on Constitutional Matters - May 2-3, 1980
36. All members were present except advisory member Edwin Weber who was attending a District
convention. The meeting opened with a prayer by Carl Eberhard.
37. Minutes: The minutes of the previous meeting were approved as submitted,
38. Agenda: Items just received this morning were added to the agenda: Memphis High School and
Eastern District delegates (1434 and 1435).
39. River Forest Professors (Ag. 1332): Although no further word had been received it was agreed to hold
this item on the agenda.
40. Kansas District Bylaws (Ag. 1414): The same decision was made with respect to this item in the hope
that a report of the convention's action would be received within the near future.
41. ABC District Bylaws (Ag. 1419, 1426): The Commission ratified the Secretary's letter to the effect
that paragraph 3 C (1) regarding delegates should read: provided he is on the clergy roster of the Synod."
With respect to the question of the necessity of having two attorneys on the District Commission of
Adjudication, the Commission ruled that it would be necessary to have two attorneys, and if two attorneys
are not available in the District, that the provision of Bylaw 5.55 should be utilized to supply attorney
members from the Commission of Adjudication of a neighboring District.
42. Past Eastern District Resolutions (Ag. 1420): President Arnold E. Kromphardt of the Eastern District
had asked the Secretary for assistance in dealing with the revision or recision of various questionable or
unconstitutional resolutions adopted by past conventions of the District. The Secretary had forwarded an
analysis containing nine points and had indicated how these points apply to the various resolutions which
President Kromphardt had offered for review. The Commission ratified this communication.
43. Michigan District Bylaws (Ag. 1431): The Secretary had also given a requested prior review of
proposed revisions of the Michigan District Bylaws which will be submitted after the District convention
to the Commission for ratification. He had had several suggestions to offer. The Commission noted this
analysis and also resolved to endorse strongly the position that the right to nominate should remain
ultimately with the convention.
