The faculty of our Synod's colleges and semi- naries currently has no vote in the final election of the presi- dent of the institution: and WHEREAS. The body of electors would not be as likely to have stalemated votes if there were five (5) rather than four (4) electors: and WHEREAS. Handbook Bylaw 6.117 seems to give inconsistent authority to the Board of Control in the selection of nominees for president: therefore be it Resolved. That the 1975 convention of the LCMS amend Bylaw 6.115 by adding the following phrase: “and the faculty as a group with one vote”: and be it further Resolved. That the third sentence of Bylaw 6.117 be revised to read: “A majority of the electors may add to the list supplied by the faculty committee (6.113), after consultation with the faculty committee and the Board of Control.” Ohio District Carl A. Brummé, Secretary 6-28 To Revise Bylaw 6.117, Election of President of Institution WHEREAS. The Synod previously has recognized the rights and privilege of the faculty of a synodical school to advise its Board of Control in the election of its president: and WHEREAS. The confidence and endorsement of a faculty is vital to the administration of a president: therefore be it Resolved. That Bylaw 6.117 be revised to read: “The electors, with the members of the Board of Control voting as individuals, shall elect a president from the list of nominations supplied and endorsed by the faculty committee of the respective insti- tution. The Board of Control and electors shall not add to this list of nominations.” English District Robert L. Landeck. Secretary 6-29 To Revise Bylaws for Election of College and Seminary Presidents WHEREAS, Prior to the New Orleans convention of The Lutheran Church — Missouri Synod in 1973 presidents of colleges and seminaries in the Synod were elected by means of the process summarized as follows: 1. Nominations were called for and received by the local Board of Control. 2. A faculty committee elected by the faculty gathered information on these nominees and selected an unspecified number of them to be advanced as candidates to the electors. 3. The electors consisted of the President of the Synod (one vote), the chairman of the Board for Higher Education (one vote), the President of the synodical District in which the institution was located (one vote), and the Board of Control (one vote as a unit). 4. The electors could elect only from those who had been advanced to candidacy by the faculty committee: and WHEREAS, This procedure seemed to concentrate excessive power in the hands of the faculty committee because electors could elect only from those advanced to candidacy by the faculty committee: and WHEREAS, In an attempt to redress this apparent imbalance, the New Orleans convention amended Handbook 6.117 to read: “A majority of the electors, with the members of the Board of Control voting as individuals, may add to the list supplied by the faculty committee (6.113), after consultation with the Faculty Committee” (p. 152), thus the counsel of the faculty committee: and WHEREAS, Previously the power to select persons for candi- dacy from the list of nominees was vested in a faculty committee that had no vote in the election process, it is now possible for three votes ithe President of the Synod, the chairman of the Board for Higher Education, the President of the synodical Dis- trict, who may or may not be a member of the Board of Control), none of which necessarily reflect local concerns, to effect an election without recourse on the part of the faculty, the students, or their committee: and WHEREAS. Those most intimately affected by the election of a president are often unable to have a significant influence in selecting their chief administrative officer: therefore be it Resolved. That Handbook 6.113, 6.115, and 6.117 be amended to read as follows: 6.113 The Search Committee A committee of as many members as the total membership of the respective Board of Control (faculty members elected by the faculty: 2 students elected by the student body) shall carefully analyze the needs of the institution, the requirements of the Synod, and the academic and personal qualifications of the nominees. To this end the secretary of the Board of Control shall make available to this com- mittee all information, recommendations, and objec- tions he shall receive. On the basis of its studies the Search Committee shall propose for the electors’ consideration the names of nominees it considers qualified for the position. 6.115 Electors At a meeting of the Board of Control held to elect a president, there shall be present and voting as electors: the members of the Board of Control as a group with one vote (the District President not voting with the board): the members of the Search Committee as a group with one vote: the President of the synodical District or his official representative with one vote: the President of the Synod or his official representative with one vote: and the chairman of the Board for Higher Education or his official representative with one vote. 6.117 Election The election shall be held on the day designated in the notice published in the official publication of the Synod or as soon thereafter as feasible. The electors shall give due consideration to the recommendations and statements of qualifications and objections sub- mitted on behalf of all nominees. One half plus two of the electors (the members of the Search Committee and the members of the Board of Control shall vote as individuals) may add to the list of those proposed by the Search Committee (6.113). If the electors are unable to complete the election, they may postpone the election and request the Board of Control to issue a new call for nominations.
