Res. 5-17 Adjudicatory Process This referred resolution also dates back to the Milwaukee convention. Milwaukee Res. 5-11 had asked the committee to study the adjudicatory process of the Synod. The same conven- tion, however, in Res. 5-14 had established Commissions of Adjudication (Proceedings. 1971, pp. 156—59). In view of the establishment of these commissions, the committée recom- mended to the New Orleans convention that no further action was required at that time. Consequently the New Orleans Floor Committee prepared Res. 5-17, which merely suggested a change in the name from commission to board. Lack of time, however, did not enable the convention to adopt the resolution. Under Omnibus Res. 4-47 this was referred to the Board of Directors, and through it to the Committee for Reorganization. In the past biennium the committee reviewed the adjudicatory process extensively on the basis of several study documents, and as a result found that clarification of the procedure is needed. In view of this, the committee recommends to Anaheim adoption of the following resolution as a substitute for Res. 5-17: WHEREAS, The Committee for Reorganization has examined the comprehensive Milwaukee convention Res. 5-14 which established the Commission of Adjudication (Proceedings. 1971, pp. 156—59): and WHEREAS, The new adjudicatory process is in need of some clarification: and WHEREAS, For the sake of consistency in terminology it is advisable to change the name from commission to board: therefore be it Resolved. That the name of the Commission on Adjudication be changed to Board of Adjudication: and be it also Resolved. That a new section be incorporated in the Bylaws as 5.16 as follows: a. When a person holding a position with the Synod, as defined in Bylaw 5.09 c hereof, shall be charged by a member or an officer of the Synod with any or all of the following: 1. Professional incompentency: 2. Incapacity for the performance of duty because of physical, mental, or emotional disability: 3. Refusal to cooperate or contumacious conduct: 4. Neglect or refusal to perform duties of office: 5. Conduct unbecoming a Christian: 6. Acceptance and advocacy of doctrines and religious beliefs in opposition to and inconsistent with those doctrines and religious beliefs held and and approved by the Synod and as set forth and understood in Article II of the Constitution of the Synod: 7. Failure or refusal to carry out duties assigned under or conduct in violation of the Constitution and Bylaws of the Synod or its Districts: he shall be charged and given notice of such charge and dealt with on an informal basis, as provided in Bylaws 5.03 and 5.11 hereof, and shall have an op- portunity to be heard and to have the charge or charges adjudicated as provided in Bylaws 5.13 and 5.21 hereof, and his suspension shall be governed and and be in effect as provided in Bylaw 5.15 hereof.
