# LCMS Commission on Constitutional Matters Minutes_St. Louis Missouri_December 10 1976_S4 # Machine transcription, uncorrected — CHI Digital Archive (demonstration) the Synod, suggesting that the original intention was not to have an ordinary Board of Directors and that perhaps the name of the Board should be something like "Finance Committee; Ways and Means Committee; Property and Finance Committee; Trustee Committee; Fiscal Management Committee." The Commission takes strong exception to the suggestion that items on the CCM agenda should be screened (censored?) by the Board of Directors and that opinions should not be of any binding nature until a subsequent convention came to such a conclusion. Constitutional rulings should not be made by the District presidents or a committee of the Council. Furthermore, District presidents should not be voting members of boards of control of our educational institutions. The Secretary was asked whether he would develop such an essay which could be circulated among the members for reaction and could then be submitted together with the entire questionnaire over the signature of the chairman, Herbert Freise. It was also resolved that Herbert Mueller should serve as the designated representative to appear before the Task Force for further explanations. 211. Concordia Historical Institute (Ag. 1131, A, 1131B): The Secretary reported that the Concordia Historical Institute had withdrawn its request for an interpretation of New York Resolution 13-17 with reference to inclusion of the CHI in the 125th Anniversary Thankoffering. 212. Hispanic Seminary, (Ag. 1135): The Texas District Board of Directors through President Heckmann had asked for a ruling on whether the Fort Wayne seminary had the right to begin a seminary extension program for Hispanic ministries at River Forest in view .of the reference to Austin in Anaheim Resolution 6-10. After some discussion the Commission resolved to have the Secretary inform the petitioners that the Commission had been unable to give full attention to this matter because of the press of other business but that it had been informed that a meeting would be held in the near future to arrive at some conclusion regarding this difficulty. If after that meeting the Board of Directors of the Texas District still felt that the matter had not been resolved, perhaps the Board could reinstitute its request for a ruling and supply also additional information and argumentation. 213. Faculty Member as Member of a Board of Control (Ag. 1142): In answer to a request from the Seward Board of Control the Commission ruled that a member of the Board of Control who had accepted appointment to the faculty of another synodical institution could not continue as a member of the Board of Control (Bylaw 6.25 f) and that the vacancy needed to be filled as prescribed in Bylaw 6.29. 214. English District Bylaws (Ag. 653): The Commission decided to hold this item on the agenda. 215. California-Nevada Evasion of CCM (Ag. 933A): The same decision was made with respect to this item. 216. New Jersey Bylaw Regarding Indemnity of Officers (Ag. 995): This request for a review of the proposed bylaw could not be acted on since no response had been as yet received from legal counsel Phil Draheim. 217. Lodge Paragraph in Congregation Constitutions (Ag. 1016, 1016A): In answer to this request from Rev. Ray Wessler of Calumet City, Illinois it was decided to ask Pastor Lochhaas for a written statement concerning the question. 218. Jacobs - Grunow Conflict (Ag. 1023): That part of this item which had not yet received action was retained on the agenda for the time being. 219. Ohio District Resolution Re Call of District President (Ag 1028): The carbon copies regarding this matter were also retained on the agenda for possible future developments.
