# LCMS Commission on Constitutional Matters Minutes_St. Louis Missouri_March 15 16 1973_S7 # Machine transcription, uncorrected — CHI Digital Archive (demonstration) letter and scanned the congregation's constitution during the course of the meeting. In answer to what seemed to be the two questions raised by the congregation the commission decided to reply as follows: 1. Try to gain near unanimous consent to change the unalterable articles and then after amendment remove these sections from the unalterable list. 2. The commission assumes that the congregation is in the process of revising its constitution and therefore suggests that the congregation decide what it wishes to do in the case of division and dissolution and then consult a good Michigan attorney to draft the proper article for the constitution. 267. Northwest District Guidelines for Selective Fellowship (Ag. 265 B): The secretary called attention to this document for study in connection with the assignment given the commission in concert with the CTCR and CMMC. 268. Campus Ministries, Selective Fellowship, San Francisco Night Ministry (Ag. 384, 385, 387, 397, 265, 290): No report has been received as yet from the CTCR in answer to the request except the acknowledgement that the CTCR is already at work on this problem and appreciates the urgency and the importance of the concerns relayed to it by the commission. 269. Texas District Bylaws (Ag. 6A): The new 1973 edition of the Texas District Bylaws were distributed to replace the old which had not yet been approved by the commission (Ag. 6). 270. District Bylaws (Ag. 6A, 9, lh 12, 236,.344, 344A, 365, 383): Some discussion was devoted to the necessity to review these bylaws which had been on the agenda for a long time. The meeting adjourned with the Lord's prayer in unison. Herbert Mueller, Secretary CONCORDIA, RIVER FOREST, PRESIDENCY (Addressed to the Electors c/o Mr. Roland Eggerding) You have asked whether a member of the Lutheran Church in America may be elected as President of Concordia Teachers College, River Forest. On the basis of the clear implications of various articles in the constitution and bylaws of our Synod, the Commission on Constitutional Matters holds that a member of the LCA cannot serve as President of Concordia. However, from your letter and other sources we have learned that the person under consideration was trained in our Missouri Synod's system of colleges, served on the faculty of our River Forest Concordia, and was not expelled from our Synod, but joined an LCA congregation at the time that he accepted the presidency of an LCA college. All this would indicate that the person under consideration may very well be successful in an application for reinstatement to the Missouri Synod roster under the provisions of bylaw 3.51. Although this bylaw applies specifically to the pastoral ministry roster, the commission holds that it should apply also in this case.
