# LCMS Commission on Constitutional Matters Minutes_St. Louis Missouri_September 10 1960_S3 # Machine transcription, uncorrected — CHI Digital Archive (demonstration) Rev. Dan R. Ludwig Page Five March 30, 1961 to our Committee was for a more immediate decision, Whether we declare the Resolution constitutional or unconstitutional, it is apparent that Synod itself will be asked to pass upon the identical questions involved, either upon direct appeal or on appeal from any decision which we would make. Upon consideration of all of these circumstances, and because of the certainty that Synod itself will act in some manner with respect to the first resolution of the English District asking Synod to declare Resolution 9 unconstitutional at the next Convention, it is the opinion of the Committee on Constitutional Matters that it would be unwise, and is in fact unnecessary at this time, to express any opinion as to whether Resolution 9 is unconstitutional on the ground that it is contrary to or conflicts with Article II of the Constitution of Synod. That specific question has not actually been presented to our Committee, In View of the present status of Resolution Number 9 and the certainty of its amend- ment, any opinion on our part whether it might or might not be constitutional in some amended form would be premature and improper. We pray that the Spirit of God, who searcheth the heart, will lead all members of Synod to understand clearly the issues that are involved and will grant to our Church a peaceful solution that will reflect absolute loyalty to the Word of the Lord and a brotherly concern that all of us may continue to be one in faith and practice.
